Narragansett Bay Yachting Association (“NBYA,” “we,” “our,” or “us”) provides this website, https://www.nbya.org (the “Site”), to inform and connect sailing enthusiasts, members, and the public. By accessing or using the Site, you agree to these Terms of Use (“Terms”). If you do not agree, please do not use the Site.

Permitted Use

You may use the Site to:

  • View sailing event schedules, race results, and NBYA news.

  • Register for events, renew memberships, or make donations.

  • Access member resources, newsletters, and sailing resources.

  • Contact NBYA staff or submit inquiries.

Use the Site only for lawful purposes and in compliance with these Terms.

Intellectual Property

All content on the Site—including text, logos, event schedules, race results, photos, and graphics—is owned by NBYA or its licensors and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or commercially exploit Site content without written permission from NBYA.

User Content

When you submit content (e.g., comments, event registrations, photos):

  • You grant NBYA a worldwide, royalty-free, perpetual license to use, modify, and display it.

  • You represent that your content does not infringe third-party rights or violate laws.

  • NBYA may moderate or remove content at our discretion.

Prohibited Conduct

Do not:

  • Post harmful, illegal, or offensive content.

  • Attempt to hack, disrupt, or overload the Site.

  • Use automated tools to scrape or harvest data.

  • Impersonate others or misrepresent your affiliation with NBYA.

Event Registrations and Payments

Event registrations and payments are subject to separate terms from payment processors (e.g., Stripe, PayPal). NBYA is not liable for transaction disputes handled by third parties. All sales are final except where required by law.

Third-Party Links and Services

The Site may link to external sites (e.g., regatta platforms, yacht clubs) or embed third-party services (e.g., HubSpot forms, Google Maps). NBYA is not responsible for their content, privacy practices, or availability.

Disclaimer of Warranties

The Site and its content are provided “as is” without warranties of any kind, express or implied. NBYA does not guarantee accuracy, completeness, or uninterrupted access. Sailing event information is subject to change due to weather or other factors.

Limitation of Liability

To the fullest extent permitted by law, NBYA is not liable for any damages arising from Site use, including direct, indirect, incidental, or consequential damages. This includes issues related to event registrations or reliance on Site information.

Termination

NBYA may suspend or terminate your access to the Site at any time for violation of these Terms.

Governing Law

These Terms are governed by Rhode Island law. Any disputes will be resolved in Bristol, Rhode Island courts.

Changes to Terms

We may update these Terms periodically. Continued Site use after changes constitutes acceptance. Material updates will be posted here with the new date.
